Constitutional Law

“Everyone has the right to life, liberty and security of the person, and the right not to be deprived thereof except in accordance with the principles of fundamental justice”.

- Section 7 of the Charter or Rights and Freedoms.

Peter Jensen was one of the first lawyers in British Columbia to realize the potential of the Charter of Rights and Freedoms as a tool for defending against criminal charges. As part of the Constitution, the Charter embodies the central principles of Canadian democracy: fairness, equality before the law, justice, and dignity.

The Charter limits the conduct of police officers. A police officer cannot simply stop and search you, or your property, for any reason. If a police officer arrests you, they are not permitted to ignore the myriad of procedural rights designed to protect you, such as allowing you to contact and speak with a lawyer.

For example, if your Charter rights were breached in the course of your arrest, it can result in your charges being dropped. Since 1982, Jensen Law has successfully represented many clients who have experienced breaches of their Charter rights.
